Baby Proofing Service Terms & Conditions
These Terms & Conditions apply to all childproofing inspections, recommendations, products supplied and installation services provided by Baby Proof SA (“Baby Proof”).
They should be read together with the quotation provided to the client and any applicable product manufacturer’s instructions or warranties.
1. PURPOSE OF CHILDPROOFING
Childproofing products and safety modifications are intended to provide an additional layer of protection against reasonably foreseeable hazards.
No childproofing product or installation can replace responsible adult supervision. Parents, caregivers and other responsible adults remain responsible for supervising children and for taking reasonable precautions to keep children safe.
Baby Proof cannot guarantee that childproofing will prevent every accident, injury or incident.
2. CLIENT RESPONSIBILITIES
The client remains responsible for maintaining a safe environment for children.
The following should always be kept out of children’s reach, regardless of any childproofing measures installed:
- Toxic, poisonous or hazardous substances;
- Sharp or pointed objects;
- Glass objects;
- Small objects that may present a choking hazard;
- Dangerous tools or equipment; and
- Other items that may reasonably pose a risk to children.
The client is also responsible for following the manufacturer’s instructions for all products installed and for ensuring that products remain correctly positioned and functional after installation.
3. INSPECTION, RECOMMENDATIONS & QUOTATION
Following an inspection of the premises, Baby Proof will provide a written report and/or recommendations identifying childproofing measures that, in Baby Proof’s professional opinion, may improve the safety of the premises.
Where applicable, Baby Proof will provide a quotation setting out the proposed products, installation services and associated costs.
The client is free to accept or decline individual recommendations unless otherwise agreed in writing.
The quotation will specify the work and products included in the proposed installation.
4. ADDITIONAL WORK
If additional products, materials or installation work are required that were not included in the original quotation, Baby Proof will advise the client where reasonably possible.
Additional work will only be carried out with the client’s approval and will be charged separately.
5. DEPOSIT & BOOKING OF INSTALLATION
An installation date will only be confirmed once the required deposit has been paid and cleared in Baby Proof’s bank account.
Products will not be reserved and an installation date will not be confirmed until the required deposit has been received, unless otherwise agreed in writing.
The quotation will specify the deposit amount and any applicable payment terms.
6. INSTALLATION DATES & CHANGES
Baby Proof will make reasonable efforts to accommodate the client’s preferred installation date.
Once an installation date has been confirmed, the client should notify Baby Proof as soon as possible if the appointment needs to be changed.
Where a cancellation or postponement results in costs being incurred by Baby Proof, reasonable charges may apply, subject to applicable law and the circumstances of the cancellation.
7. INSTALLATION & COMPLETION
Installation will generally take place within seven (7) working days after the required product payment has cleared, subject to product availability and the agreed installation schedule.
The remaining balance of the quotation will be payable following completion of the installation, unless otherwise agreed in writing.
Once installation has been completed, Baby Proof will explain the operation, use and relevant care requirements of the installed products to the client.
8. CHANGES TO THE INSTALLATION
The client must not alter, remove, relocate or modify any installed childproofing product without first consulting Baby Proof or, where appropriate, the product manufacturer.
Any alteration or deviation from the recommended installation may reduce the level of protection provided by the childproofing system.
Baby Proof cannot accept responsibility for problems resulting from unauthorised alterations, misuse or modifications made after installation.
9. ADHESIVES, FIXINGS & INSTALLATION METHODS
Baby Proof installations are carried out in accordance with the applicable manufacturer’s installation instructions and using the appropriate fixings, adhesives or installation methods for the product and installation surface.
Where suitable, adhesive or other non-permanent installation methods may be used to minimise damage to existing surfaces.
The suitability of a particular installation method may depend on the condition and type of the installation surface.
10. ADHESIVE SETTING PERIOD
Where adhesives are used, the installed product may require a setting period before it reaches its intended level of adhesion.
Where applicable, products installed using adhesive should be left undisturbed for at least 24 hours after installation, or for the period specified by the product manufacturer if longer.
The client will be advised of any relevant setting or curing requirements following installation.
11. PRODUCTS & MANUFACTURER WARRANTIES
Baby Proof uses products from established suppliers and manufacturers and will take reasonable care to supply products suitable for their intended childproofing application.
Manufacturer warranties, where applicable, remain subject to the individual manufacturer’s terms and conditions.
If a product supplied by Baby Proof is found to be defective, Baby Proof will assess the matter and provide the appropriate remedy in accordance with applicable consumer protection legislation and any applicable manufacturer warranty.
Damage resulting from misuse, abuse, unauthorised modification, incorrect use or failure to follow the manufacturer’s instructions may not be covered by a manufacturer’s warranty.
12. WORKMANSHIP & INSTALLATION DEFECTS
Baby Proof will perform installation services with reasonable care and skill.
If you believe there is a problem with the installation or workmanship, please notify Baby Proof as soon as reasonably possible so that the matter can be inspected and, where appropriate, remedied.
Nothing in these Terms & Conditions excludes or limits any rights or remedies that the client may have under applicable South African law.
13. ADDITIONAL CALL-OUTS
Call-outs requested more than fourteen (14) days after completion of the installation may be charged at:
- R1250 for the first hour or any portion thereof; and
- R250 for each additional hour or portion thereof.
These charges do not apply where the call-out relates to a defect in the original installation or another matter for which Baby Proof is responsible under applicable law.
Products that require replacement due to misuse, accidental damage, unauthorised alteration or failure to follow the manufacturer’s instructions may be charged separately.
14. CLIENT INSPECTION & ACCEPTANCE
On completion of the installation, the client will have the opportunity to inspect the installed products and discuss their operation and use with Baby Proof.
The client is encouraged to raise any concerns before the installation team leaves the premises so that they can be addressed promptly.
Payment of the outstanding balance does not waive any statutory rights the client may have.
15. QUOTATIONS
Unless otherwise stated on the quotation, quotations are valid for fourteen (14) days from the date of issue.
Prices may change after the quotation validity period due to changes in product pricing, availability, supplier costs or other circumstances.
A quotation only becomes binding once accepted by the client and confirmed by Baby Proof.
16. ACCESS TO THE PREMISES
The client is responsible for ensuring that Baby Proof has reasonable access to the areas requiring inspection or installation at the agreed appointment time.
The client should advise Baby Proof in advance of any access restrictions, security requirements, parking limitations or other circumstances that may affect the installation.
17. SAFETY & ONGOING RESPONSIBILITY
Childproofing products are designed to reduce access to identified hazards, but they are not a guarantee against accidents or injuries.
Products may require periodic checking, maintenance or adjustment.
The client is responsible for regularly checking installed products and reporting any damage, looseness, deterioration or malfunction to Baby Proof.
Products should be used only for their intended purpose and in accordance with the manufacturer’s instructions.
18. CHANGES TO THESE TERMS & CONDITIONS
Baby Proof reserves the right to update these Terms & Conditions from time to time.
The Terms & Conditions applicable to a particular installation will be those provided to or accepted by the client in connection with that installation, together with any subsequent written amendments agreed between the parties.
19. ENTIRE AGREEMENT
The accepted quotation, these Terms & Conditions and any written agreement specifically relating to the installation constitute the agreement between Baby Proof and the client regarding the relevant childproofing service.
If there is a conflict between these Terms & Conditions and a specific written term in the accepted quotation, the specific agreed term will apply to the extent of that conflict.
20. SEVERABILITY
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as severable from the remaining provisions.
The remaining provisions will continue to apply to the extent permitted by law.
21. GOVERNING LAW
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Nothing in these Terms & Conditions is intended to exclude, restrict or limit any consumer right or remedy that cannot legally be excluded or limited under applicable South African law.
IMPORTANT SAFETY NOTICE
Childproofing is a supplementary safety measure and does not replace responsible adult supervision.
Parents and caregivers remain responsible for supervising children and for taking reasonable steps to ensure that the environment remains safe.
